Village of Lake Villa v. Stokovich, 95118
In a dispute arising from a demolition order entered pursuant to a state statutory provision contained in section 11-31-1 of the Illinois Municipal Code, a ruling that the Municipal Code provision was unconstitutional as a denial of due process is reversed where the statute was valid under the police power. Nevertheless, the demolition order is vacated as it was unsupported by evidence establishing the property's current value, as a prerequisite to a ruling on whether or not the building was repairable.
