Convictions on one of two counts of theft arising from the same set of circumstances are vacated where: 1) conviction under either theft count was justified by the evidence, therefore the verdicts were not legally inconsistent; and 2) there is a violation of the one-act, one-crime rule because both charges arose from the same conduct.
