Hines v. Dep't of Public Aid, 100841
In a claim for reimbursement of the Medicaid benefits made against the estate of the spouse of the Medicaid recipient, such a claim is not allowed where federal law, which provides the framework within which the Department of Public Aid administers Medicaid, does not allow the Department to seek recovery from the estate of a surviving spouse.
