Supreme Court of Illinois

People v. Garvin, 99031

Conviction for burglary and theft is affirmed over constitutional challenges to defendant's warrantless arrest and the statute that mandates DNA sampling of convicted felons where: 1) the facts established probable cause for the defendant's arrest; and 2) because the defendant could not show that the DNA sampling statute was invalid as applied to him, he necessarily could not mount a facial challenge to it.
