Supreme Court of Illinois
Langenhorst v. Norfolk S. Ry. Co., 99924
In a wrongful death claim arising from a collision between plaintiff's decedent and a defendant's train, defense forum non conveniens motion is denied where the witnesses in this case were scattered in terms of their residences and defendant had not met its burden of showing that the circuit court had abused its discretion in refusing to disturb the plaintiff's choice of forum.
