Harshman v. DePhillips, 99805

In a suit against a treating doctor in a personal injury matter, defendant-doctor's motion to dismiss is granted where: 1) a request to file a contribution claim against the doctor was denied during the original personal injury action; and 2) the Illinois' Contribution Act bars the bringing of a claim in a separate proceeding after a court of another jurisdiction has denied the party leave to file the claim in the original action.
