Supreme Court of Illinois

People v. Olender, 98932

In an action brought under section 1301 of the Illinois Income Tax Act for filing a fraudulent income tax return, motion to dismiss is affirmed based on a finding that section 1301 was unconstitutionally amended by Public Act 88-669 in violation of the single subject clause of the Illinois Constitution and is therefore void in its entirety
