People v. Phillips, 98070

In an action for possession of child pornography with intent to disseminate, conviction is affirmed over claims that the pictures were not shown to depict real children where: 1) a trier of fact can determine this issue without expert advice; and 2) the trier of fact in this case had properly done so. The court also rejects claims of fourth amendment violations where the initial discovery of the pictures had been made by a private technician, rather than by the government, and the defendant had made Mirandized statements and consented to a search of his home.
