In declaratory judgment action regarding the duty to defend or indemnify a defendant in a personal injury accident where defendant's conduct fell within the terms of an exclusion set forth in the insurance policy, summary judgement in favor of plaintiff is affirmed where the automobile coverage extended by statute to permissive users does not call for a different result in a case where coverage has already been excluded by a specific clause in the policy in question.
