Blue v. Environmental Engineering, Inc., 98034

In a products liability action that proceeded in negligence, reinstatement of the jury verdict for plaintiff is affirmed where: 1) the trial court found that the jury's verdict was inconsistent with its answer to a special interrogatory regarding the open and obvious nature of the risk of injury; and 2) the interrogatory was improper as it did not resolve an ultimate issue in the case and was not necessarily inconsistent.
