Supreme Court of Illinois

People v. Bush, 97603

Conviction for two counts of possession of cocaine with intent to deliver is affirmed over claims that the State failed to prove both intent to deliver and that the substance was cocaine where: 1) evidence that the defendant remained standing behind a fence after performing two transactions out of a bag that was later shown to contain cocaine was sufficient to prove that she intended to perform further transactions based on what was left in the bag; and 2) the defendant had stipulated to the qualifications of the technician and the admission of his conclusion and, therefore, had waived the issue of whether the substance was cocaine.
