People ex rel. Ryan v. Agpro, Inc., 97986

In an action seeking injunctive relief, recovery of remediation costs, and civil penalties related to allegations that defendants caused or allowed the soil at their business site to be contaminated by pesticides, judgement is affirmed where: 1) the plain language of the statute did not authorize the issuance of a mandatory injunction for cleanup; and 2) the fact that the statute was amended after the appellate court decision does not call for a different result.
