Supreme Court of Illinois

Ferguson v. City of Chicago, 97218

In an action for malicious prosecution, dismissal of the action is reversed and the cause remanded over claims that the complaint was untimely where: 1) the underlying misdemeanor proceedings did not terminate with the striking of the charges because the prosecution could still reinstate them; 2) the proceedings terminated only when the speedy-trial period expired without any reinstatement; and 3) the malicious prosecution complaint was filed within one year of the expiration of the speedy-trial period.
