In an action arising from the demolition of buildings under a provision of the Counties Code, dismissal is vacated and the cause remanded where the motion to dismiss was based on a claim that the provision under which demolition was sought was unconstitutional because: 1) a provision of the Municipal Code parallel to the County Code provision in question had been held by the appellate court in 2002 to deny due process; and 2) the appellate court ruling was later reversed by the supreme court.
