Supreme Court of Illinois
In re Parentage of John M., 97227, 97327cons.
In a petition to determine a father-child relationship brought pursuant to section 7 of the Illinois Parentage Act, dismissal of the suit based on claims that the Act is unconstitutional is reversed where: 1) a holding that the statute denied due process or equal protection as applied was premature because there had been no evidentiary hearing and no findings of fact; and 2) a conclusion that the statute is unconstitutional on its face is unsupported because it was not shown that there were no circumstances under which the statute would be valid.
