People v. Ortega, 93834

Order disqualifying defendants' counsel on conflict of interest grounds is affirmed where the trial court did not abuse its discretion as it: 1) could reasonably conclude that there was at least a serious potential for conflict; 2) applied legally correct criteria as it weighed the interests that were threatened by the conflict; and 3) reasonably concluded that the factors favoring disqualification overcame the presumption in favor of counsel of choice.
