In a claim arising from the death of a child in foster care asserting that the private, nonprofit child welfare service which had placed the child in the home was vicariously liable for negligence under the doctrine of respondeat superior, the appellate court's reversal of the circuit court's denial of a motion for a judgment n.o.v. for the defense is allowed to stand where the Supreme Court could not reach agreement.
