Supreme Court of Illinois

Zaabel v. Konetski, 96581

In a direct action for writ of prohibition, the request for writ is denied where: 1) the claim of lack of subject matter jurisdiction is focused on the fact that all the relevant individuals now live in other states and relies on a provision of the Uniform Interstate Family Support Act; 2) this provision is properly construed not to apply to jurisdiction to enforce support orders; and 3) plaintiff failed to meet his burden of showing that anything other than support-order enforcement was involved.
