Supreme Court of Illinois
PEOPLE v. GRECO, 89940
Section 4-103.2(b) of the Illinois Vehicle Code is constitutionally infirm as it applies to special mobile equipment, because it violates due process by removing the requirement that a piece of equipment be recently stolen in order for possession of the equipment to give rise to an inference that the possessor knows that the equipment was stolen.
