Summary judgment in favor of defendant in a suit seeking injunctive relief from defendant's denial of plaintiff's requests for the superintendent's employment contract under the Illinois Freedom of Information Act (FOIA) is reversed and remanded for further proceedings where: 1) to the extent that a personnel file contains both information that bears on public duties and private information the trial court must determine through an in camera inspection whether the requested information is exempt as a clearly unwarranted invasion of personal privacy and whether the presence of exempt private information can be cured through redaction; and 2) voluntary disclosure of a per se exempt item can preclude later claims of exemption and such a determination is a question of fact.
