People v. Galmore, 4-07-0073
Conviction of unlawful possession with intent to deliver of a controlled substance and a sentence of 19 years in prison plus a mandatory imposition of a street-value fine of ten thousand dollars is vacated and the case remanded where: 1) the fine was not supported by the evidence; and 2) although a court may adopt reliable evidence from the trial testimony as a basis for determining value, it is unclear how the court determined the value of the fine other than just accepting the state's figure.
