People v. Sitkowski, 2-07-0305

An order dismissing a charge against the defendant for violation of his speedy trial rights is affirmed where: 1) release from incarceration did not toll the speedy-trial period; 2) the speedy-trial demand made by defendant while in custody under the intrastate detainers act remained in effect after he was released; and 3) defendant was released on mandatory supervised release and was still in DOC custody under the plain language of the statute.
