Newton Tractor Sales, Inc. v. Kubota Tractor Corp., 5-06-0087

Summary judgment for the defendants and an order granting motion for court appearance fees but denying deposition transcription fees and deposition subpoena fees to the defendants in an action to recover damages on a theory of promissory estoppel is affirmed where: 1) promissory estoppel is only available as a defense and not a cause of action; and 2) the trial court did not abuse its discretion in denying the defendant's motion to tax the costs of deposition transcription fees and deposition subpoena fees since they were not necessary for use at a trial because there was no trial.
