Summary judgment for defendants on a claim alleging breach of contract to perform medical billing services and unjust enrichment is affirmed where: 1) the agreement constitutes an illegal fee splitting arrangement in violation of section 22 of the Medical Practice Act; and 2) plaintiff is unable to sue in equity for unjust enrichment where there was a contract between the parties although the contract was void as a matter of law.
