Appellate Court of Illinois

People v. Hunt, 1-06-0824

Grant of defendant's motion to suppress evidence is affirmed where the trial court neither: 1) erred in suppressing defendant's statements to an incarcerated inmate made during the course of a judicially authorized overhear; nor 2) abuse its discretion by excluding the defendant-inmate overhear tapes which the State argues were only "partly inaudible". Underlying evidence was properly suppressed as they were fruits of defendant's illegal arrests.
