Appellate Court of Illinois

People v. Bair, 1-06-2656

Conviction and sentence for DUI is affirmed over defendant's claims that: 1) the results of her BAC test should have been excluded because the doctor failed to swab her arm prior to drawing blood, as then required by the Illinois Administrative Code (20 Ill. Admin. Code section 1286.320(c)(2004); and 2) she received ineffective assistance of counsel because her trial counsel failed to file a motion in limine to exclude the test results.
