Appellate Court of Illinois
People v. Grimes, 1053888
Conviction for criminal drug conspiracy and multiple counts of the lesser-included offense of delivery of a controlled substance is affirmed over claims that: 1) defendant's trial counsel provided ineffective assistance; 2) defendant's sentence should be vacated because the trial court relied on improper factors in sentencing him; and 3) the mittimus must be corrected to accurately reflect defendant's sentencing credit and his actual conviction of a Class 1 offense, as opposed to a Class X felony. The clerk of the circuit court is directed to correct the mittimus to show that the defendant was convicted of a Class 1 felony.
