In a five-count putative class-action complaint alleging that defendant received contingent commissions from insurers without informing plaintiff, granting of defendant's motion to dismiss is reversed as to counts I, IV, and V where the conduct alleged in plaintiff's complaint constituted the "misappropriation" of money received as premiums. Granting of the motion to dismiss is affirmed as to the remaining counts.
