In a defamation suit arising from the distribution of a handbill (count I) and display of a banner (count II) allegedly imputing to plaintiffs professional incompetence, order granting summary judgment in favor of defendants on count II is affirmed where no reasonable jury could find that the banner was not substantially true. Judgement in favor of plaintiffs on count I is reversed where the handbill was not actionable as it did not contain any factual assertions.
