In a suit seeking a declaratory judgment to reinstate plaintiff's health insurance policy and damages for breach of contract resulting from defendant's cancellation of the original policy, summary judgment for defendant is affirmed over claims that the trial court erred by: 1) finding that certain insurance application representations were false as a matter of law; and 2) finding that the misrepresentations were material.
