Foster v. Johnson, 1060822

In an action for damages sustained from a battery which the defendant allegedly committed against the plaintiff while both parties were at work as employees of the Chicago Transit Authority, dismissal with prejudice of plaintiff's cause of action is reversed and remanded for a hearing to determine whether the plaintiff's injury is compensable under the Workers' Compensation Act, for purposes of precluding the instant action.
