Appellate Court of Illinois

People v. Irvine, 1060005

Conviction for domestic battery is affirmed over claims that: 1) the state failed to prove defendant guilty beyond a reasonable doubt; 2) section 12-3.2 of the Criminal Code of 1961 is unconstitutionally vague; 3) defendant received ineffective assistance of counsel; and 4) the trial court erred in its recollection of the evidence when it weighed the credibility of witnesses and found the defendant guilty. A minor traffic ordinance violation fee is vacated and defendant is entitled to a credit of $10 for the two days he was incarcerated prior to sentencing.
