Cook County Republican Party v. The State Bd. of Elections, 1053407
In a consolidated appeal challenging the Illinois State Board of Elections' dismissal, without a public hearing, of 10 complaints alleging Election Code violations, all ten dismissals are affirmed where: 1) as to two of the dismissals, the Board's findings and application of those findings to the law are not clearly erroneous; and 2) as to the remaining eight dismissals, the court is without authority to decide de novo whether the complaints were filed on justifiable grounds and the Board complied with the statutory directive of section 9-21 of the Election Code when it could not muster a five-vote majority.
