In an action arising from an effort by the General Assembly to provide property tax relief through the enactment of an alternative homestead exemption, dismissal of complaint for declaratory and injunctive relief is affirmed over claims that the circuit court erred: 1) when it determined that plaintiffs' complaint did not state a legally cognizable claim in attempting to demonstrate that section 15-176 of the Property Tax Code violated the Illinois Constitution; and 2) by failing to recognize that there were factual issues precluding its dismissal of a count in the complaint alleging that plaintiffs' due process rights had been violated by a retroactive increase of their property taxes in 2003.
