In an interlocutory appeal arising from a medical malpractice action involving two certified questions, both questions are answered in the negative where: 1) dismissal the doctors was inconsistent with the Appellate Court's mandate and the terms of the settlement agreement; and 2) since there is no final judgment in this case, the doctrine of collateral estoppel does not limit the issue of damages to the amount of the original judgment that was vacated by the Appellate Court.
