In a suit for unjust enrichment, violation of the Consumer Fraud and Deceptive Business Practices Act, and breach of contract, dismissal of plaintiff's class action complaint is reversed and the matter remanded where: 1) the circuit court erred in dismissing plaintiff's complaint on the basis that it is preempted by sections 85 and 86 of the National Bank Act; and 2) defendant waived the issue of res judicata for purposes of this appeal.
