In an action arising from a real estate sales contract, granting of summary judgement in favor of defendant on count IV of plaintiff's complaint, which alleged tortious interference with prospective business advantage, is affirmed over claims that the trial court erred by: 1) granting defendant summary judgment on the basis of the privilege of competition; and 2) considering the privilege of competition where defendant did not plead the privilege as an affirmative defense, but raised the privilege for the first time in its motion for summary judgment.
