Wernikoff v. Health Care Serv. Corp., 1062949
In a complaint alleging violation of the Illinois Consumer Fraud and Deceptive Business Practices Act based on a medical insurance rate structure, order decertifying the class is reversed where, although more discovery occurred after the initial class certification, that discovery did not amount to changed circumstances warranting decertification. The circuit court's order granting summary judgment in favor of defendant as to plaintiff as class representative is affirmed where plaintiff cannot establish that he relied on defendant's representations.
