In a suit seeking class relief for certain customers who were charged improper and excessive fees resulting in a certified question regarding whether the court abused its discretion when it imposed the equitable doctrine of judicial estoppel to bar Blockbuster from challenging certification of a national litigation, the class certification is reversed and the matter remanded with directions where a party's position during settlement can be relevant to whether certification is proper for litigation purposes, it cannot act as de facto certification for litigation purposes.
