In a suit arising from a jurisdictional boundary line agreement between plaintiff and defendant, the trial court's orders 1) granting Sugar Grove summary judgment on Yorkville's claim for a declaratory judgment under section 11--12--9 of the Municipal Code; 2) dismissing Yorkville's claims for rescission and reformation of the Agreement; and 3) dismissing plaintiff Standard Bank from the action, are affirmed where the new version of section 11--12--9 does not apply retroactively and no mutual mistake of fact existed.
