In a consolidated action involving a legal malpractice action brought by plaintiff and a breach of contract action brought by defendant to which plaintiff had filed a counterclaim, order granting defendant's motion to dismiss plaintiff's legal malpractice complaint and counterclaim in the defendant's breach of contract action is reversed and remanded where plaintiff was not judicially estopped from bringing the claims.
