Appellate Court of Illinois

Universal Cas. Co. v. Lopez, 1053376, 1053377cons.

In a suit alleging fraudulent misrepresentation in defendants' applications for automobile insurance, denial of plaintiff-insurers motions for summary judgment is affirmed where the trial court did not abuse its discretion in finding that plaintiffs failed to meet their burdens of proof in establishing misrepresentations by the insureds and that the third-party defendants are entitled to benefits under the policy as a matter of law.
