Appellate Court of Illinois

Levaccare v. Levaccare, 1061224

In a suit alleging that defendant diverted to himself, his wife, and children, millions of dollars that plaintiff's mother intended to give to plaintiff, judgment ordering defendant to comply with a settlement agreement is affirmed where: 1) the trial court did not err when it denied defendant's motion to substitute judges as a matter of right; 2) there was no indication of prejudice on the part of the trial judge; 3) the order, from which defendant now appealed, could not revive his right to raise the same issues he could have raised before due to res judicata; and 4) since defendant failed to appeal any of the citation orders within 30 days of their entry, the court lacks jurisdiction to consider his argument.
