Appellate Court of Illinois
Weiss v. MI Home Products, 1060753
In a complaint alleging various theories of breach of warranty arising from allegations that numerous windows manufactured by defendant and installed in plaintiff's townhome failed and fogged, dismissal of plaintiff's complaint is affirmed where windows become part of real estate by their physical annexation to real estate and, therefore, they are no longer goods within the meaning of the UCC and plaintiffs do not have a valid claim under the UCC.
