In a suit arising from injuries plaintiff sustained while on duty as a fireman which led to his dismissal based on disability and subsequent denial of disability benefits, summary judgement in favor of defendant board is reversed and the matter remanded with instruction to enter summary judgment in favor of plaintiff where the Board violated plaintiff's due process rights in refusing to allow him to apply for an ordinary disability benefits hearing.
