In an action for administrative review of a decision of the Zoning Board of Appeals (ZBA), denial of an application to classify the existing use of the plaintiffs' building as a multifamily residence containing five welling units is affirmed over claims that: 1) the ZBA misapplied the zoning ordinance in determining that the property could not be certified for five dwelling units; and 2) plaintiffs' due process rights were violated when a ZBA member participated in the ZBA hearings, notwithstanding the fact that the member later recused herself from formal deliberations and did not vote on plaintiffs' zoning request.
