Matthews v. Avalon Petroleum Co., 1052606

In a personal injury action resulting from a slip and fall, judgement for defendant is affirmed over claims that the trial court: 1) erred in granting new trial because the jury's general verdict for the defendants was inconsistent with its response to the special interrogatory; 2) applied the wrong standard for determining defendant defendant's liability; 3) refused to allow deposition impeachment testimony of defendant Avalon's operations manager; 4) allowed defendant Avalon's manager to give undisclosed expert opinion testimony; 5) refused to admit evidence of defendants Avalon and PTE's failure to barricade or place warning signs; and 6) allowed erroneous jury instructions.
