Appellate Court of Illinois

Chochorowski v. Home Depot, 5060308

In an action brought under the Missouri Merchandising Practices Act, denial of a motion to dismiss is reversed where, when a venue requirement is incorporated into a statute of another state that creates a private cause of action, that venue requirement constitutes an integral part of the substantive right that was created by the statute, and Illinois courts may not use that state's general venue law to circumvent the venue limitation so provided.
