Appellate Court of Illinois

Clarendon Am. Ins. Co. v. Aargus Security Sys., Inc., 1062121

In a declaratory judgment action seeking a determination that plaintiff owed no duty to defend or indemnify defendant in lawsuits arising out of a fire, summary judgement in favor of plaintiff is affirmed where: 1) the written contract unambiguously left the insurance requirements open to a future agreement; and 2) there is no indication that a subsequent written agreement about insurance exists.
