Czarnik v. Wendover Fin. Serv., 1-06-2379
Circuit court order denying defendant's motion to compel arbitration of a counterclaim for contribution asserted by counterplaintiff-appellee is affirmed where: 1) the principle litigation precludes any subsequent arbitration of the contribution claim; and 2) the contract provides for a right of indemnification which does not foreclose the counterplaintiff from seeking arbitration on this issue.
